Privacy Policy


This privacy policy (this “Policy”) describes how the Nexprt family of websites, including specifically, everythinghome.co.in, Nexprt Solutions Private Limited, and its affiliates and subsidiaries (collectively, "Nexprt," "we," "our," or “us”), operates an online store for the sale of products, and collects, uses, discloses, and safeguards personal information that a  prospective or existing customer of Nexprt (“you” or “your”) provides on the Platforms (as defined below) or when you communicate or interact with Nexprt, including our customer service team, regardless of the geography they are based in. 


This Policy applies to individual end users who access or use the Platform and/or Services and/or otherwise use or purchase the Professional Services. For the avoidance of doubt, references to “you” across this Policy are to an end user that uses the Platform.


This Policy applies to all Nexprt websites that link to this Policy, any Nexprt mobile applications which may be used now or in the future, (the “Apps”) and other software and internet-enabled programs and services sponsored by Nexprt (collectively, the “Platforms”).


By accessing the Platforms on any computer, mobile phone, tablet, or other device (collectively, “Device”); by making a purchase from Nexprt; or otherwise communicating or interacting with Nexprt, you agree to the terms of this Policy. If you do not agree to the terms of this Policy, please do not use the Platforms.
We may modify this Policy at any time and will post the current version on the Sites as further detailed in the “Changes to the Privacy Policy” section below. We encourage you to periodically review this Policy to stay informed about how we are using the information we collect.


Key Information


The Platform may include links to third-party websites, plug-ins, services, and applications (Third-Party Services). Clicking on those links and enabling those connections may allow third parties to collect, share, or otherwise process data about you. We do not control nor endorse these Third-Party Services and are not responsible for their privacy practices or processing of personal data. When you leave the Platform or access third-party links or Third-Party Services through the Platform, we encourage you to read the privacy policy of such third parties.
Collection, Use, and Disclosure of Personal Information

We collect various kinds of information about you, including but not limited to the following:

  1. Contact Information such as your name, postal address, email address, telephone numbers, or other contact information;
  2. Personal Information such as your name, birthday, etc.
  3. Subscriber Information such as your customer ID number, username, birthday, gender, age, purchase history, rewards information, and other information you may provide us while setting up or during your subscription or usage of the Platforms and Services
  4. Purchase and order information such as contact information, purchase details, receipts, order numbers, payment details, and any communications we have received about your order or purchase.
  5. Delivery information such as name, gender, address, etc. of recipient of deliveries.
  6. Payment information including but not limited to name, card issuer, card type, credit or debit card number, PayPal, buy now pay later customer details, CVV code, billing address, Venmo, cash app, or other such information as used and provided by you on the Platform.  
  7. Product rating information such as the net promoter score, product rating, preferences, etc.
  8. Third-party information including any name, telephone number, email address, shipping address, etc. of persons to whom you may send a communication, an order, or a gift from our platform.
  9. Legal information such as fraud checks, flags against your transactions, details of your payment card refusals, suspected crimes, complaints, claims, and accidents.
  10. Preference information such as your marketing preferences, account settings, preferences that you may have indicated while using our Platform, the types of services/products/offers that interest you and the areas of the Platforms that you have visited or ways that you interact with our Platforms.
  11. Marketing and communication data such as information posted in service requests, offers, wants, feedback, responses to user surveys and polls, preferences received in marketing communications from us and third parties, your communication preferences as well as chat and call records when communicating on / via the Platforms.
  12. Communications we have with you including recorded calls with our service team.
  13. Any voluntary information that you choose to provide us with / through your communication with us.
  14. Information such as your photos, pictures, and audio recordings you upload to our Platform, recordings of phone calls you make to our phone numbers, identification information when you visit our facilities, and video and audio recordings collected at our premises.
  15. Personalization and engagement data such as Your journey online and how you use our Platforms, whether and when you open our marketing emails and push notifications and respond to our advertisements, what you clicked through on our Platforms, and what your purchased.
  16. Device information such as Your IP address, internet provider, operating system and browser used, type of Device (such as laptop or smartphone), Device cookie settings and other Device details (such as MAC address and geolocation) if you use our Platform and permit it to obtain your precise geolocation.
  17. Browser information such as the data transferred from your browser to our servers, including your browser type, your operating system type or mobile device model, your viewed webpages, links that are clicked, your IP address, your mobile device identifier or other unique identifier, sites or apps you visited before coming to the Platforms, the amount of time you spend viewing or using the Platforms, the number of times you return to the Platforms, or other click-stream or site usage data as well as emails we send that you open, forward, or click through to the Platforms.
  18. Details of your identity, image, name and address, and suspected or alleged thefts, fraud, assault or other criminal behavior.

Data Retention

When you use the Platform, we will maintain your information for our records unless and until you ask us to delete this information.

How do we use your Personal Data / Information?

We may use any information/data collected from you for processing and other purposes including without limitation:

  1. To verify your identity, register you as a user, and create your user account with us on the Platform;
  2. To provide the Services including sending you information and updates about the services/products you have purchased;
  3. To monitor trends and personalize your experience;
  4. To improve the functionality of our services and platform;
  5. For customer service;
  6. To respond to your requests and support needs;
  7. To track transactions and process payments;
  8. To deliver your purchases to you;
  9. To send periodic notifications to manage our relationship with you, including to notify you of changes to the services, send you information and updates pertaining to the services you have used, and to receive occasional company news and updated related to us or the Services;

  12. To improve our business and delivery models;
  13. To help us screen for potential risk and fraud;
  14. To improve and optimize our Platform (for instance by generating analytics about how our customers browse and interact with the Platform);
  15. To develop, target, and assess the success of, marketing and advertising campaigns;
  16. To perform our obligations that arise out of the arrangement we are about to enter, or have entered with you;
  17. To enforce our terms; 
  18. For other purposes as we may require for business purposes, or as otherwise disclosed to you at the time information is collected.

Can you refuse to provide personal data?


Where we need to collect personal data to provide the Services, respond to your communications, or under the terms of a contract (such as the Terms), and you fail to provide that data when requested, we may not be able to provide the Services, respond to your communications, or perform services under the contract (for example, to provide you with the Services).


We may use and share information that has been de-identified, or aggregated for any lawful purpose. Aggregated personal information does not personally identify you or any other visitor or user of the Platforms. We may use aggregated personal information such as statistical or demographic information for any purpose, including for statistical analysis and research.
In addition to the uses set forth above, we may also use and share the categories of personal information identified below:

  • To comply with applicable legal and regulatory requests and obligations (including investigations).
  • To respond to court orders
  • To establish or defend legal claims and allegations.
  • For security or the prevention, detection, or investigation of fraud; suspected or actual illegal activity; violations of Nexprt policy or rules; or other misconduct.
  • To seek advice and consultation from lawyers, auditors, insurance companies, and other professional advisers.
  • With potential or actual purchasers of all or part of our business in connection with a business transaction.

Sharing your personal data/information:


We Share your Personal information with third parties to help us use your personal information for various purposes including for business purposes, to comply with laws, court orders, etc., for marketing, advertising, analytics, etc. For instance, we use Shopify to power our online store (you can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy).

We may also share your personal information for targeted behavioral advertising, marketing communications etc. You can opt out of some of the targeted advertising by visiting:

Transfers of Personal Data:

  1. We comply with applicable laws in respect of storage and transfers of personal data. As a part of your use of the Services, the information / personal data you provide to us may be transferred to and stored in countries other than the country you are based in, including specifically, India.
  2. By submitting information and personal data to us, you understand that such information and data will be transferred, stored, and processed in the manner described above.

Cookies, Digital Advertising, and Analytics

Like many commercial websites, we analyze how visitors use the Platforms through what is known as "cookie" technology. A cookie is a small text file that is placed on your computer when you access the Platforms and allows us to recognize you each time you visit the Sites. We may use cookies to (1) allow you to use the Platforms without having to re-enter your username; (2) enhance or personalize your Platform usage and shopping experience; (3) monitor Platform usage; (4) manage the Platforms; and (5) improve the Platforms and our products and services, including providing you with interest-based ads. If you choose, you can set your browser to reject cookies or you can manually delete individual cookies or all of the cookies on your computer by following your browser’s help file directions. However, if your browser is set to reject cookies or you manually delete cookies, you may have some trouble accessing and using some of the pages and features that are currently on the Platforms, or that we may put on the Platforms in the future. Note that browser-management tools for cookies are outside of our control and we cannot guarantee their effectiveness.


We may also use web beacons on the Platforms, in our emails, and in our advertisements on other websites. Web beacons are tiny graphic images that are used to collect information about your visit to the Platforms, such as the pages you view and the features you use, as well as information about whether you open and/or act upon one of our emails or advertisements. We may also collect the URL of the website you visited immediately before coming to the Platforms. Web beacons help us analyze the Platform visitors’ behavior and measure the effectiveness of the Platforms and our advertising. We may work with service providers that help us track, collect, and analyze this information.
We may combine the information we collect through cookies and web beacons with other information we have collected from you or information from other sources.


Digital Advertising: 
We may use on the Platforms third-party advertising companies such as those provided by Google and Facebook that use tracking technologies to serve our advertisements across the Internet. We may also partner with ad networks and other ad service providers. These advertising companies may collect information about your visits to the Platforms and other websites and your interaction with our advertising and other communications. These advertising companies serve ads on behalf of us and others on non-affiliated sites, and some of those ads may be personalized, meaning that they are intended to be relevant to you based on information collected about your visits to the Platforms and elsewhere over time. Other companies may also use such technology to advertise on the Platforms.

Analytics
We may also work with third parties that collect data about your use of the Site and other sites or apps over time for non-advertising purposes. We use Google Analytics and other third-party services to improve the performance of the Services, Platform, and for analytics marketing purposes. Security

Nexprt uses commercially reasonable physical, technical, and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure, and alteration. When you enter sensitive information (such as your credit card number) on our registration or order forms, we encrypt that information using secure socket layer (SSL) technology. Please be aware, however, that no security measures are perfect or impenetrable. You remain responsible for protecting your username and password and for the security of information you transmit to us over the internet. We will not be responsible for any unauthorized use of your information or for any lost, stolen, or compromised passwords, or for any activity on your user account due to such unauthorized use or disclosure of your password. In the event your password has been compromised in any manner whatsoever, you should promptly notify us to enable us to initiate a change of password.
Children’s Privacy

The Platforms are not directed to children under the age of 13, and Nexprt will never knowingly collect personal or other information from anyone it knows is under the age of 13. Persons over 13 but under 18 years of age may use the Platforms only in conjunction with and under the supervision of a parent or legal guardian. When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.
Third-Party Websites and Accounts

The Platforms may contain links to third-party websites, such as social media sites like Facebook, Instagram, and Twitter, which may have privacy policies that differ from our own. We are not in any way responsible for the activities and practices that take place on these websites and platforms. Accordingly, we recommend that you review the privacy policy posted on any external site before disclosing any personal information. Please contact those websites and platforms directly if you have any questions about their privacy policies.

You may choose to create accounts on websites or platforms owned or controlled by third parties to purchase our products. These third parties may use your information for their own purposes, including for behavioral advertising and analytics purposes. We do not control and are not responsible for the collection, use or other processing of your information by these third parties through the accounts you create with them. Please refer to their privacy policies to learn about how they handle your personal information.
Your Privacy Rights

You can stop email marketing from us by using the “opt out,” or “unsubscribe” mechanism at the bottom of our email marketing messages. We may give you a choice about stopping just one kind of email or opting out of all email marketing from us.

You can opt out of receiving promotional and transactional text messages via our Messaging Service by responding to any of our text messages with any of the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. 

If you want to learn more about the personal information that Nexprt has about you, or you would like to update or change that information or deactivate your account, please contact us by email. Note that deactivating your account does not cause your account information to be deleted from our servers.

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to complying with the various privacy laws that protect personal information.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:
  • We will notify the users via site notification within 7 business days.
  • We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.
Your California Privacy Rights

In addition to the rights described in the “Your Privacy Rights” section above, if you are a California resident, you may request information about our disclosure of personal information to third parties or affiliated companies for their direct marketing purposes. To make such a request, please contact us as set forth in the “Contact Us” section below. Please allow up to 30 days for us to process your request. You may submit such a request once per year.

If you are a California resident, California law also provides you with the following rights with respect to your personal information:
  • The right to know what personal information we have collected, used, disclosed and sold about you. To submit a request to know, you may email us at: support@everythinghome.co.in. You also may designate an authorized agent to request access on your behalf.
  • The right to request that we delete any personal information we have collected about you. To submit a deletion request, you may email us at: support@everythinghome.co.in. You also may designate an authorized agent to request deletion on your behalf.
  • The right to opt out of the sale of your personal information by emailing us at: support@everythinghome.co.in. You also may designate an authorized agent to request to opt out of the sale of your personal information on your behalf. 

When you exercise these rights and submit a request to us, we will verify your identity, which may include asking you to log in to your account if you have one with us. If you do not have an account with us, we may ask for your email address, order numbers of previous orders of our products and services, the last four digits of a credit or debit card or a bank account number used to make a purchase, the date of your last purchase from us, or other information that we believe you will know that will allow us to verify that the request is coming from the person named in the request.


Your exercise of these rights will have no adverse effect on the price and quality of our goods or services.

  1. Sale of personal information.
We engage in personalized or targeted advertising. In connection with such advertising, we may share or sell the following categories of information with advertising networks and providers, advertisers, analytics providers, and social media networks, which may be considered a sale under California law:
Device information and identifiers, such as unique advertising identifiers and cookies, and IP address; usage information, such as browsing history; location information, such as city; and inference data.
  1. Right to Removal of Posted Information – California Minors

If you are under 18 years of age, reside in California, and have provided us with information, you have the right to request the removal of unwanted information that you publicly post on the Site. To request removal of such information, you can contact us as provided below. Upon receiving such a request we will make sure that the information is not publicly available on the Site, but the information may not be completely or comprehensively removed from our systems and databases.

CAN – SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
We collect your email address to communicate with you regarding your use of our products and or services.   If at any time you would like to unsubscribe from receiving future emails, you can email us at support@corsicadesigns.com and we will promptly remove you from ALL correspondence.

Do No Track

Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At present, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, Nexprt and the Platforms do not recognize DNT.

Transfers Outside the United States – Cross-Border Transfer

The Platforms are intended for use by residents of the United States, however, Nexprt is registered in India. If you are visiting the Platforms from outside the United States, you understand and agree that your personal information may be transferred to, stored, and processed in the United States, India or other countries following this Policy. The data protection and other applicable laws of India or other countries may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country. Your information may be available to government authorities under lawful orders and law applicable in such jurisdictions. By using the Platforms and/or providing personal information to us, you consent to the transfer of your information to India or other countries as described in this Policy.

Changes to this Policy

We reserve the right to amend this Policy at any time. We will post all changes to this Policy on the Sites, so you should review this Policy periodically. Any such amendments to this Policy may apply to information we collect in the future as well as any information we obtained before such amendment. If we make a material change to this Policy, we will provide appropriate notice as required by law.
